Terms of Use

Last updated: 13/05/2026. These Terms of Use, hereinafter the “Terms”, govern access to and use of the Ystia mobile application.

Ystia is a local discovery and territorial gamification application. It allows users to take part in quests, routes, quizzes, challenges, observation games or interactive experiences connected to a territory, a place, heritage, an activity or a local partner.

Use of the application implies acceptance of these Terms. If the user does not accept them, they must refrain from using the application.

1. Access to the application

The Ystia application is available free of charge to users aged at least thirteen. Certain features require the creation of a user account. The user must provide accurate, complete and up-to-date information when registering.

Minor users use the application under the responsibility of their legal representatives. Where required by law, in particular for users under the age of fifteen, use of the application and processing of personal data must be authorised jointly by the minor and by the holder or holders of parental authority.

Use of the application requires a compatible device, Internet access and, for certain features, activation of permissions such as geolocation or camera access. Costs relating to the device, Internet connection or communications remain the responsibility of the user.

2. User account

Creating an account allows users in particular to take part in quests, track their progress, obtain XP, earn or use Ystia Coins, access the Shop, Treasures and partner benefits.

The account is created using an email address, a password and a username chosen by the user. The username may be visible to other users, particularly in profiles, rankings, statistics or community features. The user must choose a lawful and respectful username that does not infringe the rights of a third party.

The user is responsible for keeping their login credentials confidential. They undertake not to share their account, not to disclose their password and to notify Ystia in the event of loss of access, hacking or unauthorised use.

Any action carried out from the account is presumed to have been carried out by the user, unless proven otherwise.

The user may request deletion of their account from the application. Account deletion results in the loss of access to associated elements: progress, XP, Ystia Coins, unused Treasures, validations, statistics and game history, subject to data that may be retained in accordance with the Privacy Policy.

Simply uninstalling the application does not delete the account.

3. General rules of use

The user undertakes to use Ystia in a fair, personal, non-fraudulent manner and in compliance with the law, these Terms and the normal use of the application.

In particular, the user undertakes to respect other users, partners, visited places, residents, shopkeepers, public officials and any person encountered while using the application.

The following are prohibited in particular:

  • using the application for unlawful, fraudulent or unauthorised commercial purposes;
  • harming Ystia, partners, other users or third parties;
  • publishing or transmitting content that is insulting, discriminatory, violent, obscene, threatening, deceptive, hateful or contrary to public order;
  • impersonating a third party;
  • disrupting, diverting or compromising the operation of the application;
  • using bots, scripts, automated tools or circumvention systems;
  • attempting to gain unauthorised access to Ystia accounts, data, servers, databases or internal tools;
  • copying, extracting or exploiting Ystia content, quests, texts, riddles, game mechanics or databases without authorisation.

Any abusive, fraudulent or non-compliant use may result in cancellation of validations, deletion of XP or Ystia Coins, deactivation of Treasures, suspension of the account or permanent deletion.

4. Outdoor quests and safety

Certain quests offered in Ystia take place outdoors, in public spaces, tourist, cultural, natural, commercial or heritage locations.

The user acknowledges that these quests involve moving through a real environment, which may present risks: traffic, pedestrians, vehicles, bicycles, scooters, weather, roadworks, obstacles, stairs, slopes, slippery areas, crowds, closures or access restrictions.

The user remains solely responsible for their safety, behaviour, equipment, attention and surroundings while using the application.

In particular, the user undertakes to:

  • respect the Highway Code and the rules applicable to pedestrians, cyclists and drivers;
  • not use the application while driving or when a situation requires their full attention;
  • remain attentive to their real surroundings;
  • not enter private property or any prohibited, dangerous, closed or unauthorised place;
  • respect opening hours, instructions, signage, municipal orders and rules specific to the places visited;
  • not damage public, private, heritage, natural or commercial property;
  • interrupt or postpone a quest in the event of danger, fatigue, adverse weather, roadworks, closure or doubt about the accessibility of a place.

Maps, routes, distances, durations, difficulty levels and practical information displayed in the application are provided for guidance only. They may be inaccurate, incomplete or temporarily incorrect.

No quest should be interpreted as an invitation to take a risk, break a rule or access a prohibited place. In the event of contradiction between the application and the reality on the ground, the user must always follow signage, local instructions and safety rules.

5. Geolocation and quest validation

Certain features require geolocation to be activated, in particular to display the map, suggest nearby quests, guide the user or validate certain steps.

The user may refuse or disable geolocation from their device settings. In this case, certain features may be limited or unavailable.

Ystia is not intended to continuously track the user’s movements. Geolocation is used only when necessary for the operation of the application.

Ystia does not keep a continuous history of GPS positions. However, when a quest, step or objective is validated, Ystia may keep a record of this validation, including in particular the account concerned, the quest or step validated, the validation date and the information necessary to track progress.

This record may make it possible to infer that the user took part in an activity located in a given geographical area.

Validations may be carried out by different means: geolocation, answer to a riddle, entry of a word or code, photograph, scan, QR code, interaction with a game element or any other action provided in the application.

The user is prohibited from falsifying, simulating or manipulating their position, in particular using fake location apps, emulators, third-party software, scripts or any process enabling a quest to be validated without real presence at the place concerned.

Any geolocation fraud may result in cancellation of validations, deletion of XP or Ystia Coins, deactivation of Treasures, suspension of the account or deletion.

6. Photos, user content and visibility

Certain features may allow or require the user to submit content, including a username, profile picture, answers, photographs, statistics or progress information.

When the application asks for or allows a photo to be taken, the user must respect privacy, image rights, intellectual property rights, the rules of the places visited and these Terms.

The user undertakes not to submit content:

  • depicting an identifiable person without authorisation where such authorisation is required;
  • infringing a third party’s privacy, image or reputation;
  • reproducing a protected work, trademark, logo or document without authorisation;
  • that is insulting, discriminatory, violent, obscene, threatening, hateful, deceptive or contrary to public order;
  • created in a prohibited, private or dangerous place;
  • encouraging dangerous or illegal behaviour.

The user remains responsible for the content they submit in the application.

Photos taken as part of quests are mainly used to carry out, validate, track or keep a memory of the game experience. Ystia does not use them for external commercial, advertising or promotional purposes without the specific authorisation of the user concerned.

Certain profile or progress elements may be visible to other users, including username, profile picture, level, XP, certain statistics, badges, achievements or rankings.

Ystia may delete, hide or modify any content that is manifestly unlawful, inappropriate, deceptive, fraudulent or contrary to these Terms.

7. XP, progression and Ystia Coins

The application may allow the user to accumulate playful progress elements: XP, levels, statistics, badges, validations, achievements or Ystia Coins.

XP are used solely to represent the user’s progress within the application.

Ystia Coins are free virtual points that can be earned in the application and used, where applicable, in the Shop to obtain certain Treasures or benefits.

XP and Ystia Coins have no monetary value. They do not constitute real currency, electronic money or a means of payment. They cannot be purchased with real money, converted into money, refunded, sold, assigned, transferred or exchanged outside the features provided by the application.

Ystia may modify the rules for awarding, using, calculating or displaying XP, Ystia Coins, levels, badges, statistics or progress elements.

Ystia may correct, cancel, withdraw or adjust XP, Ystia Coins, validations or statistics in the event of a technical error, bug, fraud, cheating, abusive account creation or breach of these Terms.

If the account is deleted, the user permanently loses access to XP, Ystia Coins, statistics, levels, badges, validations, unused Treasures and associated progress elements.

8. Shop, Treasures and partner benefits

The application may offer a Shop allowing the user to use Ystia Coins to obtain Treasures, benefits, offers, discounts, products, activities or content offered by Ystia or by partners.

Available Treasures may vary depending on territories, periods, partners, stock, events, campaigns or Ystia’s editorial choices.

Each Treasure is presented with the information available at the time it is published: description, cost in Ystia Coins, partner concerned, validity period, conditions of use, limitations or place of use.

The user must consult the specific conditions of each Treasure before obtaining it.

Using Ystia Coins to obtain a Treasure results in the corresponding debit from the user’s balance. Unless otherwise stated or in the event of an error attributable to Ystia, used Ystia Coins are not returned in the event of non-use, expiration, change of mind, impossibility attributable to the user or non-compliance with the conditions of the offer.

Treasures are personal. They may not be sold, assigned, transferred, exchanged for money or used outside the methods provided in the application.

When a Treasure corresponds to a benefit offered by a partner, the partner remains responsible for their offer: availability, quality, compliance, safety, execution, opening hours, reception, access conditions and any restrictions.

Ystia is not the seller or provider of products, services, activities or benefits supplied by partners, unless otherwise stated.

In the event of a difficulty relating to the execution of a partner benefit, the user is invited to contact the partner concerned. The user may also contact Ystia to report a difficulty related to the display, acquisition or technical functioning of the Treasure in the application.

Ystia may modify, suspend, remove or replace a Treasure in the event of error, technical issue, fraud, unavailability, end of partnership, change to the offer, legal risk or circumstance beyond its control.

9. QR codes, promotional codes and fraud prevention

Certain Treasures or benefits may be associated with a QR code, numerical code, alphanumeric code, promotional code, unique identifier or any other verification or usage device.

Depending on the Treasure, use may take place:

  • by presenting a QR code in the application;
  • by scanning or verification by the partner;
  • by entering a code on the partner’s website, ticketing service or booking platform;
  • by any other method specified in the application.

The QR code, code or equivalent device is personal and linked to the user’s account, unless otherwise stated.

The user undertakes not to communicate, sell, reproduce, distribute, transfer or make available to a third party their Treasures, QR codes, promotional codes or benefits, unless the Treasure conditions expressly allow it.

When a Treasure is scanned, validated or used through a device controlled by Ystia, it may be deactivated and no longer be usable.

When a Treasure is used outside the application, in particular by entering a promotional code on a partner website or platform, its use is subject to the conditions, limits and technical methods of the partner or third-party service concerned.

Ystia and partners may refuse the use of a Treasure, QR code or code where there is a legitimate doubt as to its validity, authenticity, expiration, holder, usage status or compliance with applicable conditions.

The following are prohibited in particular:

  • using a screenshot or copy to reuse a Treasure that has already been consumed;
  • transmitting a QR code, code or Treasure to another user or third party without authorisation;
  • attempting to use an expired, deactivated, cancelled or already used Treasure;
  • falsifying a QR code, code or application screen;
  • using multiple accounts to obtain the same benefit several times;
  • any manoeuvre intended to circumvent the Shop rules or verification systems.

In the event of fraud, abuse or abnormal use, Ystia may cancel a Treasure, deactivate a QR code or code, withdraw XP or Ystia Coins obtained unduly, suspend the account or delete it.

10. Local partners and partner content

The application may present local partners: shops, activity providers, tourist establishments, cultural stakeholders, associations, local authorities, public or private organisations.

Partners may offer information, content, offers, benefits, products, activities, services, Treasures or elements integrated into certain quests.

Information relating to partners is provided by the partners or established from information communicated by them or publicly accessible. Ystia makes every effort to present it clearly, but does not guarantee its permanent accuracy.

This information may evolve independently of Ystia: opening hours, prices, closures, access conditions, availability, offers, stock or activities.

When a partner offers a benefit, product, service, activity or service through the application, they remain responsible for it.

The presence of a partner in the application does not constitute a permanent guarantee of quality, certification, absolute recommendation or commitment by Ystia regarding the experience with that partner.

Content provided by partners remains the property of its respective owners. When Ystia creates, adapts, scripts or gamifies content based on information provided by a partner, the creative, editorial, scripting, formatting, gamification, interface or game-mechanic elements produced by Ystia constitute Ystia content, unless otherwise agreed in writing.

11. Fraud, cheating and prohibited behaviour

The user undertakes to take part in quests, validations, challenges, rankings, XP acquisition, Ystia Coins, Treasures and partner benefits fairly.

Any fraud, cheating, manipulation or circumvention of the rules is prohibited.

The following are prohibited in particular:

  • using a fake GPS position;
  • abusive creation of multiple accounts;
  • using a third party’s account;
  • validating a quest or step without real presence or outside the spirit of the game;
  • unauthorised distribution of answers, codes, solutions, precise locations or elements allowing a quest to be bypassed;
  • falsifying a photo, answer, QR code, promotional code or proof of validation;
  • using bots, scripts, automated tools or technical manipulation;
  • any attempt to gain unauthorised access to Ystia systems, databases, accounts, APIs, administration tools or non-public features;
  • any attempt to resell, transfer, monetise or commercially exploit accounts, Ystia Coins, Treasures, QR codes or progress elements.

In the event of suspicion of fraud or abuse, Ystia may check activities that appear abnormal or inconsistent, under reasonable and proportionate conditions.

Ystia may in particular cancel validations, delete or adjust XP or Ystia Coins, deactivate a Treasure, exclude the user from a ranking, restrict certain features, suspend or delete the account.

Where possible, Ystia may invite the user to provide explanations before taking a final measure. However, Ystia may immediately take any measure necessary to preserve the security, fairness or proper functioning of the application.

12. Account suspension or deletion

Ystia may restrict, suspend or delete an account in the event of breach of these Terms, fraudulent, abusive, unlawful or abnormal use of the application, or behaviour that harms Ystia, partners, other users, third parties or the proper functioning of the service.

Depending on the seriousness of the facts, Ystia may in particular:

  • warn the user;
  • request modification or deletion of content;
  • cancel a validation;
  • withdraw XP or Ystia Coins;
  • deactivate a Treasure, QR code or promotional code;
  • limit access to certain features;
  • temporarily suspend the account;
  • permanently delete the account;
  • prevent or limit the creation of a new account.

Suspension may temporarily prevent access to all or part of the application.

Permanent deletion of the account results in loss of access to the account and associated elements: progress, validations, XP, Ystia Coins, badges, levels, unused Treasures, QR codes, promotional codes and partner benefits.

Account deletion does not prevent the retention of certain data where necessary to comply with a legal obligation, manage a dispute, prevent fraud, ensure service security, keep evidence or produce anonymised or aggregated statistics, under the conditions set out in the Privacy Policy.

13. Availability and evolution of the application

Ystia makes every effort to ensure access to and proper operation of the application. However, the application relies on technologies, networks, devices, operating systems and third-party services that may experience interruptions, limitations, slowdowns, errors or unavailability.

Access to the application may be disrupted in particular in the event of:

  • maintenance or updates;
  • bug, failure or technical incident;
  • interruption of Internet, mobile, GPS or Wi-Fi network;
  • issue related to the user’s device or settings;
  • unavailability of a third-party service;
  • force majeure or event beyond Ystia’s control.

Ystia may develop the application, its features, content, game rules, quests, steps, Treasures, Shop, validation systems, rankings, statistics or progress elements.

Certain quests, features, offers or content may be temporary, experimental, seasonal, localised, limited to a territory, period, partner or specific campaign.

Ystia does not guarantee that the application will be accessible continuously, permanently, without error or compatible with all devices and configurations.

The evolution, modification, suspension or withdrawal of a feature, quest, Treasure or benefit does not entitle the user to any refund, compensation or financial indemnity, except for a commercial gesture decided by Ystia.

14. Ystia’s liability

Ystia makes every effort to offer an application that is functional and suited to its purpose of local discovery, territorial gamification and access to partner content or benefits.

Ystia’s liability may only be incurred in the event of fault directly attributable to Ystia, under the conditions provided by applicable law.

Ystia cannot be held liable in particular for:

  • use of the application that does not comply with these Terms;
  • imprudent, dangerous, fraudulent or inappropriate behaviour by the user;
  • the user’s failure to comply with the Highway Code, local rules, signage or safety instructions;
  • an accident, damage, loss, theft or incident occurring during an outdoor quest, except in the event of fault directly attributable to Ystia;
  • an error, inaccuracy or unavailability related to geolocation, mapping, the network or the user’s device;
  • a breakdown, interruption or unavailability of a third-party service;
  • a modification, closure, restriction, roadworks, event, weather or local circumstance independent of Ystia;
  • inaccurate or outdated information provided by a partner or third party;
  • the availability, quality, compliance, safety or execution of a product, service, activity or benefit offered by a partner;
  • fraudulent or unauthorised use of the account resulting from fault or negligence by the user.

The information offered in the application has a playful, informational, tourist or cultural purpose. It does not replace the user’s vigilance, on-site instructions, safety rules, signage or decisions of competent authorities.

Ystia cannot be held liable for relationships, purchases, bookings, services, refusals, cancellations, delays, incidents or disputes between the user and a partner, except in the event of fault directly attributable to Ystia.

No provision of these Terms is intended to exclude or limit Ystia’s liability where such exclusion would be prohibited by law.

15. Intellectual property

The Ystia application, its architecture, interfaces, graphics, texts, images, photographs, illustrations, maps, databases, editorial content, scenarios, riddles, game mechanics, quests, steps, routes, trademarks, logos, features and more generally all of its elements are protected by applicable intellectual property rights.

Unless otherwise stated, Ystia content is the property of Ystia or is used under authorisation granted to Ystia.

The user is granted only a personal, free, non-exclusive, non-transferable and revocable right to use the application and its content for personal needs, in the context of normal use.

Without Ystia’s prior written authorisation, the user is prohibited from reproducing, copying, adapting, modifying, distributing, extracting, publishing, selling, renting, assigning, exploiting or reusing all or part of the application, its quests, texts, riddles, scenarios, game mechanics, databases or interfaces.

Partner content, such as trademarks, logos, photographs, texts, descriptions, offers or information provided by partners, remains the property of its respective owners.

The user retains rights to their own content, including profile picture, photographs or elements submitted in the application. However, the user authorises Ystia to use, host, store, display and process them to the extent necessary for the operation of the application, account management, quests, validations, support, moderation, service security and compliance with these Terms.

Ystia does not reuse user photographs or content for external commercial, advertising or promotional purposes without the specific authorisation of the user concerned.

16. External links and third-party services

The application may contain links, buttons or redirects to websites, applications, platforms, mapping services, booking services, ticketing systems, social networks, payment services or other services operated by third parties.

Accessing a third-party service may result in leaving the application or opening an external environment.

These third-party services are operated under the responsibility of their respective publishers. Their use may be subject to their own terms and conditions, privacy policies, rules of use and data processing methods.

Ystia does not control these third-party services and cannot be held responsible for their content, availability, security, operation, terms of use, business practices, data processing or any changes.

When the user uses an itinerary link, promotional code, ticketing service, booking platform or any other external service offered by a partner or third party, use of that service is subject to the conditions specific to the partner or service concerned.

17. Personal data

When using the application, Ystia may collect and process certain personal data relating to users, in particular to allow account creation, access to quests, validation of steps, tracking of progress, awarding of XP and Ystia Coins, access to Treasures, management of partner benefits, security, support and improvement of the application.

The detailed terms for collecting, using, retaining, protecting and sharing personal data are specified in Ystia’s Privacy Policy, accessible from the application and/or the Ystia website.

Depending on the case and within the limits provided by regulation, the user has rights over their personal data, including rights of access, rectification, erasure, restriction, objection and portability.

Exercising certain rights, in particular deletion of data necessary for the operation of the account, may make it impossible to access all or part of the application, and may result in the loss of progress, XP, Ystia Coins, unused Treasures, validations or personalised features.

Ystia undertakes not to sell users’ personal data to third parties.

18. Electronic communications and evidence

Exchanges between Ystia and the user may take place electronically, in particular through the application, by email, notification, contact form or message displayed in the application.

Ystia may send the user information relating to their account, the Terms, quests, Treasures, partner benefits, service security, updates or any information necessary for the proper functioning of the application.

The user must provide a valid email address and keep it up to date.

Data recorded in Ystia’s or its providers’ IT systems may constitute evidence, in particular concerning:

  • creation, access or deletion of an account;
  • acceptance of the Terms;
  • connections and actions carried out from an account;
  • quest or step validations;
  • award or use of XP and Ystia Coins;
  • obtaining, using, expiring or cancelling a Treasure;
  • generation, presentation, scan or use of a QR code or promotional code;
  • exchanges with support;
  • security, moderation or suspension measures.

The user may contact Ystia in the event of a dispute relating to an operation, validation, Treasure, QR code, code, account suspension or any other action recorded in the application.

19. Changes to the Terms

Ystia may modify these Terms at any time to take into account changes to the application, its features, game rules, content, partners, business model, applicable regulations or technical, commercial or legal constraints.

The applicable version is the one in force at the time the application is used.

In the event of a significant change, Ystia may inform the user by any appropriate means, including display in the application, notification, email or message upon account login.

Where necessary, Ystia may ask the user to accept the new version of the Terms in order to continue using all or part of the application.

If the user does not accept the modified Terms, they must stop using the application and may request deletion of their account.

20. Complaints, applicable law and disputes

These Terms are governed by French law.

In the event of a question, difficulty, complaint or dispute relating to the application, account, a quest, validation, XP, Ystia Coins, a Treasure, QR code, promotional code or partner benefit, the user is invited to contact Ystia in writing using the contact details provided in the application, on the website or in the legal notice.

Ystia will endeavour to process complaints within a reasonable time, provided the user supplies the information necessary to analyse the request.

In the event of a dispute relating to a benefit, product, activity, service or prestation supplied by a partner, the user is also invited to contact the partner concerned when the difficulty relates to the execution of its offer, opening hours, availability, access conditions, reception, booking, quality or after-sales service.

Where applicable regulations require it, the consumer user may use a consumer mediation mechanism free of charge, after attempting to resolve the dispute directly with Ystia through a written complaint. The contact details of the competent mediator will be communicated by Ystia on an appropriate medium once designated.

Mediation is optional and does not deprive the user of the right to bring proceedings before the competent courts.

Failing amicable resolution, any dispute relating to these Terms will be submitted to the competent French courts, under the conditions provided by applicable law.

No provision of these Terms may deprive the consumer user of the mandatory protective provisions they benefit from under applicable regulations.
